These Terms of Service ("Terms") govern your use of the PMPClubFit fitness coaching platform operated by Coach Javier Alejandro ("PMPClubFit," "we," "us"). By creating an account or using our services, you agree to these Terms.
1. Service Description
PMPClubFit is a personal fitness coaching platform that provides:
- Personalized workout plans created by your assigned coach.
- Custom nutrition and meal plans.
- Weekly check-in reviews with body measurements and progress photo tracking.
- Direct messaging with your coach.
- Workout calendar, reminders, and clock-in tracking.
- Daily motivational messages.
- Calorie and macro nutrient tracking tools.
2. Subscription and Payment
- The PMPClubFit subscription costs $9.99 per month.
- Your subscription renews automatically each month unless cancelled.
- Payment is processed at the time of sign-up and on the same date each subsequent month.
- All prices are in US Dollars (USD).
- There are no hidden fees. The subscription includes all features listed above.
3. Cancellation and Refunds
- You may cancel your subscription at any time through your account settings or by contacting us directly.
- Upon cancellation, you retain access to the platform until the end of your current billing period.
- Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for refund requests.
- We do not provide partial refunds for unused portions of a billing period.
4. User Responsibilities
By using PMPClubFit, you agree to:
- Provide accurate information about your health, fitness level, age, and weight.
- Consult your physician before starting any exercise or nutrition program, especially if you have pre-existing health conditions.
- Use the platform for personal fitness purposes only.
- Not share your account credentials with others.
- Communicate respectfully with your coach and other users.
- Upload only appropriate content (progress photos, workout logs, etc.).
5. Health and Fitness Disclaimer
PMPClubFit provides fitness coaching, not medical advice.
- Our workout and nutrition recommendations are for general fitness purposes and are not a substitute for professional medical advice, diagnosis, or treatment.
- Always consult a qualified healthcare provider before beginning any fitness or nutrition program.
- You exercise and follow nutrition plans at your own risk.
- Results vary based on individual effort, body type, health conditions, and adherence to the program.
- We are not responsible for any injuries sustained during workouts, whether performed at a gym, at home, or elsewhere.
- If you experience pain, dizziness, or discomfort during exercise, stop immediately and consult a medical professional.
6. Progress Photos and Content
- Progress photos you submit are used solely for tracking your fitness journey and coaching purposes.
- We will not publish or share your progress photos publicly without your explicit written consent.
- Transformation photos shown on our website or social media are shared only with the client's permission.
7. Intellectual Property
All workout plans, nutrition plans, content, branding, and materials on PMPClubFit are owned by us. You may not copy, distribute, or reproduce any content from our platform without permission.
8. Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Service.
- Engage in abusive or inappropriate behavior.
- Use the platform for unauthorized or illegal purposes.
- Fail to pay your subscription fees.
9. Limitation of Liability
To the maximum extent permitted by law, PMPClubFit and Coach Javier Alejandro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to physical injuries, health complications, or loss of data.
10. Modifications to Terms
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated Terms. We will notify you of significant changes via email or through the platform.
11. Governing Law
These Terms are governed by the laws of the State of Florida, United States. Any disputes will be resolved in the courts of Miami-Dade County, Florida.
